In 2012, Massachusetts voters passed “An Act for the Humanitarian Medical Use of Marijuana”. The historic initiative gave patients diagnosed with a qualifying medical condition the right to legally purchase medical cannabis products.

Medical Marijuana Patients In Massachusetts

To get a medical marijuana card in Massachusetts, you first have to be seen by a registered physician who will determine if you suffer from a qualifying medical condition as defined by the state. If you do qualify, your doctor will give you a PIN that will enable you to complete your registration and application on the state Cannabis Control Commission website. Once you’ve completed these steps and paid the $50 fee, you’ll receive your Massachusetts medical marijuana card in the mail.

Purchasing Medical Marijuana In Massachusetts

As a patient with a Massachusetts medical marijuana card, you can shop at a medical marijuana dispensary on your own. You can also designate up to two caregivers to provide you with medical marijuana, as long as they aren’t working for any other patients.

Medical Marijuana Qualifying Conditions

There are nine major qualifying medical conditions that enable you to get a medical marijuana card in Massachusetts. They are:

  • AIDS
  • ALS
  • Cancer
  • Crohn's disease
  • Glaucoma
  • Hepatitis C
  • HIV
  • Multiple Sclerosis
  • Parkinson’s Disease
  • Any other conditions as determined in writing by a qualifying patient's physician

Medical Marijuana Caregivers In Massachusetts

To become a caregiver for a medical marijuana patient, you must be 21 years of age or older. Your patient will need to give you their PIN in order to register with the state as their medical marijuana caregiver. As a caregiver, you’re allowed to have one medical marijuana patient whom you can assist with cultivation or purchasing.

Medical Marijuana Protections For Physicians

Under “An Act for the Humanitarian Medical Use of Marijuana in Massachusetts”, physicians and healthcare providers are protected from prosecution for advising medical marijuana patients in the state.

Protection Against Forfeiture And Arrest

Medical marijuana patients and dispensary agents in Massachusetts are protected from arrest and forfeiture if they follow state law. Protection covers:

  • Lawful possession
  • Transfer
  • Cultivation
  • Distribution
  • Transport
  • Manufacture of medical marijuana

Operating Motor Vehicles Under The Influence Of Medical Marijuana

Be aware. It’s unlawful in Massachusetts to operate machinery such as a car, boat, or plane while under the influence of medical marijuana in the state.
